USER AGREEMENT AND PUBLIC OFFER
This document is a public offer by Otis LLP (OTIS Security trademark, the “Company”). It governs use of the Company website, submission of requests and remote information services for any individual or legal entity (the “User”).
Using the website, completing a contact form or submitting a request constitutes the User's full and unconditional acceptance of this Offer.
1. Subject of the Offer
1.1. The Company gives the User access to information about security services, including security, panic and fire alarm systems, video surveillance, central monitoring and response, and enables the User to submit a request through the website.
1.2. Information on the website, including service descriptions, articles and answers to questions, is provided for general information and is not a technical security-system design. The system configuration and the quantity and placement of equipment are determined after an on-site survey by a Company engineer.
1.3. Prices and rates shown on the website are for information only, do not constitute a public offer as to the final price, and may be adjusted after the property survey. The final price is recorded in the quote and contract.
1.4. Security services are provided under a separate written agreement entered into by the Company and the Customer after the property survey. This Offer does not replace that agreement and does not create an obligation for the Company to protect the property.
2. Requests and communication
2.1. To obtain a consultation, request an engineer or receive a quote, the User submits a website request containing their name, contact telephone number and property details.
2.2. By submitting a request, the User confirms that their contact details are current and consents to a call or messenger communication from a Company specialist to clarify the requirements and agree a survey time.
2.3. The property survey and quote are free and do not oblige the User to enter into a contract.
2.4. The Company may reschedule an agreed survey after notifying the User through the supplied contact details.
3. Rights and obligations of the parties
3.1. The User may:
— access publicly available information on the website at any time;
— use website forms to submit a request;
— cancel an agreed survey at any time by notifying the Company by telephone or messenger;
— withdraw consent to personal data processing in the manner established by the Privacy Policy.
3.2. The User must:
— provide accurate contact details;
— not use website materials for unlawful purposes or commercial gain without the Company's consent;
— not take any action that disrupts operation of the website.
3.3. The Company may:
— change the website structure and design, service list and rates unilaterally, with updated information taking effect when published on the website;
— suspend the website for maintenance;
— refuse to process a request containing knowingly false information.
3.4. The Company must:
— process received requests during the sales department's business hours;
— process personal data in accordance with the Privacy Policy.
4. Intellectual property
4.1. All materials on the website, including text, design, logos, photographs of properties and employees, videos and graphic elements, belong to the Company or are lawfully used by it and are protected by the copyright laws of the Republic of Kazakhstan.
4.2. Copying, distributing or otherwise using website materials without the rights holder's prior written consent is prohibited.
5. Limitation of liability
5.1. The Company is not liable for direct or indirect loss resulting from use of, or inability to use, the website.
5.2. The Company is not liable for decisions made by the User on the basis of general website information without an on-site survey by a specialist.
5.3. Service quality, timeframes, response procedures, warranties and financial liability are governed by the written security services agreement entered into with the Customer.
5.4. The Company is not liable if the website is unavailable for reasons outside its control, including telecommunications or hosting-provider failures.
6. Final provisions
6.1. Matters not covered by this Offer are governed by the laws of the Republic of Kazakhstan.
6.2. The Company may amend this Offer. Amendments take effect when published on the website.
6.3. This Offer remains in force indefinitely until withdrawn by the Company.
